US Judge Mandates Release of Abrego Garcia from Immigration Detention

A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks legal authority.

"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The case originates in a erroneous removal to El Salvador earlier this year, which US authorities later admitted was an error. After his repatriation to the United States to answer alien smuggling charges, he was detained in immigration custody.

In her decision, the court pointed out that the authorities lacks a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

Context of the Legal Challenge

The court challenge involve conflicting claims. While the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this allegation.

He has also entered a not guilty plea to the smuggling counts, which are part of a separate trial in Tennessee.
